1. About these Terms
These Website Terms and Conditions (the “Terms”) govern your use of the Sanctuary Graduates website, jobs board, candidate registration pages and related online services (together, the “Website”).
The Website is operated by Sanctuary Search Ltd, trading as Sanctuary Graduates (“Sanctuary Graduates”, “we”, “us” or “our”), a company registered in England and Wales under company number 08013693.
By using the Website, registering with us or submitting an application through the Website, you agree to comply with these Terms. If you do not agree with them, you should not use the Website.
These Terms relate to use of the Website. Separate terms, notices, application requirements or client-specific conditions may apply to particular recruitment processes, events or services.
2. Our services
Sanctuary Graduates provides early careers recruitment, attraction, screening, assessment and candidate management services. The Website may allow you to view opportunities, register your interest, create or maintain a candidate profile, submit applications, complete recruitment stages and communicate with us.
Use of the Website by candidates is generally free of charge. We do not charge candidates recruitment fees for being considered for opportunities.
Information about an opportunity is provided for recruitment purposes. Unless expressly stated otherwise, a job advertisement or other Website content is not an offer of employment and does not create an employment relationship between you and Sanctuary Graduates or any employer.
We may support recruitment processes on behalf of third-party employers. Decisions regarding progression, interview, offer and employment may be made by the relevant employer, by Sanctuary Graduates within an agreed recruitment process, or jointly, depending on the engagement.
3. Candidate registration and applications
You are responsible for ensuring that information you submit is accurate, complete and not misleading. You should update information where it materially changes during an active recruitment process.
You must only provide information about another person where you are authorised or otherwise lawfully permitted to do so.
Where an opportunity has eligibility requirements, including right-to-work, location, qualification or other criteria, you are responsible for answering relevant questions accurately. We or the relevant employer may ask for evidence where appropriate.
Submitting an application does not guarantee progression, interview, assessment, an offer or employment. Recruitment decisions will be made using the criteria applicable to the relevant opportunity.
If you require a reasonable adjustment or accessibility support, you may contact us through the routes provided in the relevant application process or candidate communications.
4. Candidate accounts and security
If you create an account, you are responsible for keeping your login details confidential and for activity carried out through your account, except where activity results from a security failure for which you are not responsible.
You must not share passwords or deliberately allow another person to impersonate you in a recruitment process.
You should notify us promptly if you believe your account, application or personal information has been accessed or used without authorisation.
We may suspend access where reasonably necessary to protect the security of the Website, candidate information, a recruitment process or another user.
5. Acceptable use
You must use the Website lawfully, fairly and only for legitimate purposes connected with the services it provides.
You must not:
• attempt to gain unauthorised access to the Website, another user’s account, systems or data;
• introduce malware, malicious code or other material intended to damage, disrupt or compromise systems;
• scrape, harvest, extract or systematically copy Website data except where permitted by law or with our written permission;
• use automated tools in a way that materially disrupts the Website or circumvents application controls;
• submit false, fraudulent, discriminatory, abusive, unlawful or deliberately misleading content;
• infringe the intellectual property, confidentiality, privacy or other rights of Sanctuary Graduates, an employer, another candidate or a third party;
• use the Website to send unsolicited marketing, spam or other unauthorised communications; or
• interfere with the fair operation of a recruitment or assessment process.
6. Recruitment assessments and technology
Recruitment processes may use approved applicant tracking, video interview, assessment, screening or other recruitment technologies.
Where artificial intelligence, profiling or automated tools are used to assist with recruitment, they will be used subject to the safeguards, transparency and human oversight described in our External Privacy Notice and applicable data protection requirements.
You must complete assessments honestly and in accordance with the instructions provided. Unless expressly permitted, you must not have another person complete an assessment on your behalf, obtain unauthorised assistance, or interfere with assessment security or scoring.
Where technical problems affect an application or assessment, contact us as soon as reasonably possible. We will consider appropriate next steps in the circumstances, which may include technical support, a re-invite or an alternative arrangement where appropriate.
7. Intellectual property
The Website and its content, including text, branding, graphics, logos, design, databases, software and recruitment materials, are owned by or licensed to Sanctuary Graduates or the relevant rights holder and are protected by intellectual property law.
We grant you a limited, personal, non-exclusive and revocable right to access and use the Website for legitimate personal recruitment and job-search purposes.
You may not reproduce, sell, license, commercially exploit, modify, distribute or republish material from the Website except where permitted by law, expressly permitted on the Website, or agreed by us in writing.
Employer names, logos, job descriptions and other client materials may be owned by the relevant employer or another third party and remain subject to their rights.
8. Content you provide
You retain ownership of content and information that you provide to us, subject to the rights necessary for us to operate the Website and provide recruitment services.
You give us permission to host, copy, transmit, store, review and otherwise use content you submit to the extent reasonably necessary to administer your account, application, assessment or recruitment services and in accordance with our External Privacy Notice.
You must not upload content that you do not have the right to provide, or content that is unlawful, malicious or materially misleading.
We may remove or restrict access to content where reasonably necessary for security, legal, regulatory, recruitment-integrity or operational reasons.
9. Data protection and privacy
Personal data is processed in accordance with applicable data protection law and our External Privacy Notice.
Our External Privacy Notice explains the categories of personal data we collect, how and why we use it, the lawful bases we rely on, who information may be shared with, international transfers, retention, recruitment technology and the rights available to individuals.
Where a particular recruitment process involves additional or materially different processing, further privacy information may be provided through the relevant application form, platform, employer notice or candidate communication.
These Terms do not replace, limit or alter any rights you have under applicable data protection law.
10. Cookies
The Website may use cookies and similar technologies for essential functionality, security, preferences, analytics and other purposes.
Where consent is required for non-essential cookies, we will seek it through the relevant cookie controls. Further information should be available through the Website’s cookie notice or consent interface.
11. Third-party websites and services
The Website may contain links to, or integrate with, websites and services operated by third parties, including employers, assessment providers, video interview platforms, job boards or other recruitment technology providers.
We are not responsible for third-party websites or services that are outside our control. Their own terms, privacy notices and policies may apply.
The inclusion of a link does not necessarily mean that we endorse all content, products or services available through that third party.
12. Website availability and changes
We aim to keep the Website available and accurate but do not guarantee uninterrupted or error-free access.
We may change, suspend, withdraw or restrict all or part of the Website where reasonably necessary for maintenance, security, legal, regulatory, operational or commercial reasons.
We may correct or update Website content, including job information, deadlines or process information. Where a material change affects an active recruitment process, we will take reasonable steps to communicate it to affected candidates where appropriate.
13. Accuracy of information and recruitment outcomes
We take reasonable care when publishing recruitment information. However, information supplied by employers or third parties may change, and roles may be amended, paused, withdrawn or filled.
You should rely on the most recent information provided for a live recruitment process and contact us if you are unsure about a material requirement.
Nothing on the Website constitutes legal, immigration, tax, financial or other professional advice. Where specialist advice is required, you should obtain it from an appropriately qualified adviser.
14. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.
Subject to the above, Sanctuary Graduates will not be responsible for losses that were not reasonably foreseeable, losses caused by circumstances outside our reasonable control, or business losses suffered by an individual using the Website primarily for personal job-search or recruitment purposes.
We are not responsible for the acts or omissions of an employer or other independent third party, although we will take appropriate steps where an issue relates to a recruitment service we are providing.
15. Suspension or termination of access
We may suspend or terminate access to the Website or a candidate account where reasonably necessary because of a material breach of these Terms, fraud, misuse, security concerns, unlawful activity or conduct that threatens the integrity of a recruitment process.
Where appropriate and lawful, we will take account of the circumstances before taking action. Suspension or termination of Website access does not affect rights or obligations that have already arisen.
16. Changes to these Terms
We may update these Terms from time to time to reflect changes in law, regulation, technology, our services or Website operation.
The latest version will be published on the Website. Where a change is material and it is appropriate to do so, we may take additional steps to bring it to users’ attention.
Your continued use of the Website after updated Terms take effect will be subject to the updated Terms.
17. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A delay or failure by us to enforce a provision does not amount to a waiver of our rights.
These Terms do not give any third party a right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
These Terms, together with any expressly incorporated notices or process-specific terms, set out the terms governing use of the Website. They do not replace any separate agreement between Sanctuary Graduates and an employer or client.
18. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer resident in another part of the United Kingdom, you may also have rights to bring proceedings in the courts applicable to your place of residence. Nothing in these Terms removes any mandatory rights you have under applicable law.
